Chapter 13 bankruptcy is a chapter in the US which governs the US bankruptcy codes. These let individuals to go under the supervision of the federal court and allow reorganization. This provides the debtors with the relief if they fulfill the requirements of the court in this case sometimes their debts are secured and they get relaxation from their goals. This comes under the chapter 13 bankruptcy as this was predefined in chapter 7. In this case the debtor has the right to convert to some other chapter as he wants it to deal like in the court of law. So in several cases the debtor is made free and gives relaxation of the loans he has taken if he is under the circumstances that he is unable to make any payments. In some cases the individual cannot go for a particular chapter specifically chapter 13 if he is short of money to file the chapter. So in that case he checks for the one which he can easily go for and can ask for help too.
So it also depends on the ability of the debtor that for which chapter he can file easily and is applicable to file for. Otherwise he won’t be given privilege in the court to stand for hi right. This is very important thing and comes in first place. The chapter 13 bankruptcy demands a promise of the debtor to pay his lender or the creditor in the period of three to five months at maximum. When the case is in progress the creditor cannot force his debtor to pay for that in the period of 35-40 days as this is illegal and the court has the right to ask for the debt under the case chapter 13 filed at the court. So the situation is out of control of the creditor and now is the court involved in between to get to the debts that the debtor has to pay.
